Find the Title Document Before Anything Else

If the home is manufactured and no HCD Form 433A was recorded, the home is personal property. Its ownership lives on an HCD Certificate of Title, or on older units a DMV pink slip and registration card, rather than on the deed to the land.

That single fact reorganises the whole transaction. You would be selling two things: land by deed, and a titled chattel through HCD. The framework is on our page covering the contract and the title.

What If I Cannot Find It?

It is recoverable. HCD operates a Registration and Titling Program and a title search will show the registered owner and any recorded legal owner or junior lienholder. That search is also how you find out whether something is owed against the home, which will not appear anywhere in the county records. Doing it early is far better than doing it during a sale.

The Lien Nobody Finds

The specific trap on this stock. A title search at the county recorder can come back clean while the home standing on the land carries a lender or a junior lienholder recorded at HCD.

Buyers relying on a county search alone miss it entirely, and it surfaces when a transfer is attempted. Enforcement agencies verifying a conversion compare the HCD title search against the surrendered documents precisely to establish that the registered owner holds the home free of liens or encumbrances.

Does a Burned Home Still Carry Its Title?

The title record does not disappear because the unit burned, and dealing with it is part of resolving the property. That is one of the more common reasons a Valley file stalls: an owner treats a destroyed manufactured home as debris, and finds that the thing they want to remove and the thing that is still titled and possibly encumbered are the same object.

The Inherited Case

Where an owner has died and the home has no recorded 433A, a transfer upon death document recorded at the county recorder's office is not sufficient to effect a title change at HCD.

Families here complete what looks like a full transfer through the recorder and discover months later that the home never moved. It is fixable, and it is worth establishing at the start rather than after the paperwork has been done twice.

Values Make the Arithmetic Tight

Repair costs what the trades charge regardless of neighbourhood, and across this area a full repair frequently approaches or exceeds the finished value.

On a manufactured unit that is more often true again, because replacement rather than repair is commonly the realistic route once a fire has reached the structure. Establishing what the property would be worth put right is the first number to get.

The Statutes Behind a Manufactured Home File

Health and Safety Code section 18551 was added in 1979 effective 1 January 1980. Units installed on foundation systems under sections 18551, 18551.1 and 18555 are not registered by HCD and transfer by deed.

Mobile homes first sold before July 1980 may be subject to an HCD licence fee or to local property taxes, and homes with a recorded 433A are assessed under Proposition 13 with increases capped at 2 per cent a year.

On the land side, Government Code sections 51200 and 51244 create a rolling 10 year contract, with 9 years to unwind by nonrenewal or a 12.5 per cent cancellation fee under section 51282.
