Old Files Have Gaps

Housing here goes back a long way, and the paper trail behind it has usually passed through several hands, several decades and at least one informal transfer.

What that produces is not fraud, it is absence. Additions built without permits. Second units whose status nobody recorded. Deeds that name people who died years ago. Why Does That Matter More After a Fire?

Because rebuilding forces every one of those questions into the open. An addition nobody permitted is a structure the city has no record of, and putting it back is a permitting question rather than a repair. A second unit whose status is unclear may or may not be replaceable. Owners who establish these before pricing anything avoid discovering them halfway through a rebuild.

Second Units Are Common and Under-Recorded

Lots here frequently carry more than one dwelling, and the second is often older, smaller and less documented than the main house. Sometimes it is a manufactured unit placed on the lot years ago.

Where that is the case the second question on this site becomes live: a manufactured home without a recorded 433A is personal property with its own HCD title, and it does not transfer with the deed to the land.

How Do I Find out About the Second Unit?

The title report for the land, and separately a search of HCD's records for anything titled at that address. A clean county search tells you nothing about a titled unit sitting on the parcel, because the unit is not part of that record. It is a genuinely easy thing to miss and an expensive one to miss at closing.

The Provisions Behind an Older Fresno File

Health and Safety Code section 18551 was added by Assembly Bill 887, chapter 1160, in 1979 and took effect on 1 January 1980. Homes installed under sections 18551, 18551.1 or 18555 become real property once the certificate of occupancy is recorded.

Government Code section 51200 and following carries the land side, with a rolling 10 year term under section 51244 and a cancellation fee of 12.5 per cent under section 51282.
