Not Every Home Here Is Part of the Land

The Valley has a great deal of manufactured and mobile housing, and in California such a home can be one of two legally different things.

Under section 18551 of the Health and Safety Code, a manufactured home installed on a foundation system becomes a fixture or improvement to the real property. Once the certificate of occupancy is recorded, the unit is real property, is subject to local property taxation, and future title transfers are by deed. No title is issued by the Department of Housing and Community Development.

Without that, the home is personal property. It has a title issued and tracked by HCD, much like a vehicle, and it transfers the way a vehicle does rather than the way a house does.

How Would I Know Which I Have?

The document is HCD Form 433A, recorded at the county recorder's office at the time the permanent foundation was permitted and occupancy approved. A preliminary title report should reveal whether one was recorded. If there is no 433A, there should instead be an HCD Certificate of Title, or on older units a DMV pink slip and registration card. One or the other exists, and knowing which is the first thing worth establishing.

Why That Changes a Fire Sale Completely

If the home is real property, you are selling a burned house on land and the transaction is ordinary.

If it is personal property, you are selling two things: the land, by deed, and a titled chattel, through HCD. And HCD withholds registration or transfer of registration until the applicant presents a tax clearance certificate, or a conditional tax clearance certificate, issued by the tax collector of the county where the home is located.

What If the Owner Has Died?

This is where it bites hardest. For a home without a recorded 433A, a transfer upon death document recorded at the county recorder's office is not sufficient to effect a title change at HCD. Families work through the recorder, get what looks like a completed transfer, and discover the home itself never moved. It is fixable and it is much cheaper to know at the start.

And Not Every Parcel Is Free to Be Developed

The second question, and it is the one that comes with Fresno County's geography.

The Williamson Act, formally the California Land Conservation Act of 1965 at Government Code section 51200 and following, lets landowners contract with a city or county to keep land in agricultural or open space use. In return the land is assessed on its agricultural use value rather than its market value. Roughly 10 million acres statewide are enrolled.

A contract has a minimum ten-year term, and under section 51244 a year is added automatically on each anniversary unless notice of nonrenewal is given. That makes it a rolling ten-year contract, and it runs with the land and binds all successors in interest.

So a Buyer Inherits It?

Yes, which is why it belongs in the first conversation rather than in escrow. A buyer who did not know about a contract and finds it in the title report revises both their number and their plans, because it constrains what can be done with the parcel. A buyer who knew from the start prices it once and holds.

The Terms That Move the Number Here

Whether a 433A is recorded. It decides what is being sold and how.

Whether an HCD title exists, and who is on it. Legal owners and junior lienholders appear there rather than in the county records.

Whether the land is under contract. And whether any notice of nonrenewal has been filed.

How much land there is. Acreage is the strongest signal on the second question.

Which jurisdiction. The city, Clovis, the county and the smaller valley cities each permit separately.

Anyone quoting without asking what kind of home it is has priced a transaction they have assumed the shape of.

Getting Out of a Contract Takes Time or Money

Nonrenewal. Either the owner or the local agency files a notice under section 51245. The remaining term, nine years where the original was ten, runs out, and the annual assessment increases each year until it reaches ordinary rates. No fee, and it cannot be filed during the first ten years of a contract.

Cancellation. Immediate, initiated by the landowner, and it requires the board of supervisors to make specific findings under section 51282. The owner pays a cancellation fee equal to 12.5 per cent of the unrestricted fair market value of the property, and cancellation does not become effective until the fee is paid.

Farmland Security Zones Are Stricter Again

A tighter version of the same programme. Farmland Security Zone contracts carry a minimum initial term of twenty years, the nonrenewal countdown runs nineteen years rather than nine, and the cancellation fee doubles to twenty-five per cent of unrestricted fair market value.

Whether a parcel is under a standard contract, an FSZ contract, or none at all is a question for the county rather than one to infer from the surroundings.

How the Timeline Runs

An open claim does not prevent a sale. What lengthens a Fresno file is a home nobody established the legal character of, and a parcel nobody checked for a contract.

The foundation matters and the recorded form is what proves the conversion. Look for a 433A in the title report rather than reasoning from what the home sits on.
